There could be numerous reasons for evicting a tenant from your property. Depending on the seriousness of the problem, you can decide the period for serving the eviction notice. If you have signed a lease agreement with the tenant, there are certain rights and responsibilities that each group has on the other.

Any state law follows a “notice” and “process” policy. That is, according to the lease agreement, you have to send a prior notice to the tenant stating clearly that you wish to terminate the lease contract and are not interested in renewing it any further. This should be done in advance, preferably a month or two, depending on your state laws, so that the tenant is well informed about your decision. You cannot ask the tenant to evict immediately. Your action will be subject to legal action if you decide to do so.

You can evict a tenant under the following conditions:

  • If the tenant violates the terms and conditions of the lease contract
  • If the tenant refuses to pay rent on time
  • If the tenant has caused undue damage to the exteriors and interiors beyond the normal wear and tear
  • If the tenant has been involved in illegal activities

You can also speak to an attorney or lawyer to get legal advice and support to move court if need arises. You should also mention the reason for eviction in the lease eviction letter. If you wish to file a petition, you should provide proof and evidence to back your reason for eviction.
