Writing an eviction notice is not that simple and one has to know the landlord and tenant rules in order to do that. The eviction letter usually serves as the notice letter where the tenant is warned of the possible eviction legally by the landlord. However, this is a must by the rules.

An eviction letter should simply state the date and time of eviction and should ask the tenants to vacate by that time. Also, it should be received by the tenant and the landlord should have a proof of the same. An unserved notice is not considered a notice because the tenant will not know about it if he or she has not read it at all. A landlord can give a written notice much before filing the case in the court and in case the tenant is not vacating in spite of it then the landlord can approach the court and ask them for an eviction notice.

The legal eviction notice is usually sent by the court. However, a notice that a landlord is sending should contain a subject, reason for eviction and also the time period of eviction. It should also contain a last date or an end date until when the tenant could stay. Every state has a specific notice period like 60 days or 90 day period. The tenant should find out what laws and rules apply in the state he or she lives and should follow the rules exactly. However, without legalities involved no landlord should act on their own in order to avoid troubles.
